Welcome to Genius Limo! By booking our services, you agree to the following Terms and Conditions. Please read them carefully before making a reservation. These terms govern the relationship between you (the "Client") and Genius Limo (the "Company"), a limousine service provider operating in the Commonwealth of Virginia.
Eligibility: The Client represents that they are at least 18 years of age and legally capable of entering into a contract under Virginia law. For prom reservations, a parent or legal guardian must make the booking on behalf of minors.
Reservation: A reservation is confirmed upon receipt of a deposit (see Section 2) and a signed contract or acknowledgment of these Terms and Conditions.
Payment: Full payment is due at least 7 days prior to the service date unless otherwise agreed in writing. We accept credit cards (Visa, MasterCard, American Express), cash, Zelle, or certified checks. A valid credit card must remain on file for incidental charges (e.g., damages, overtime).
Overtime: Overtime beyond the contracted hours will be billed in 30-minute increments at the prevailing hourly rate, payable to the chauffeur in cash or charged to the card on file at the end of service.
2.1 General Deposits: A non-refundable deposit of 25% of the total service cost is required to secure a reservation unless otherwise specified.
2.2 Prom Season Refund Policy (April 1 – June 30): Due to high demand during prom season:
3.1 Vehicle Availability: Vehicles are assigned based on availability. Genius Limo reserves the right to substitute a comparable vehicle if the requested one becomes unavailable due to maintenance or unforeseen circumstances.
3.2 Passenger Capacity: The Client agrees not to exceed the maximum passenger capacity of the assigned vehicle, as dictated by safety regulations and insurance requirements under Virginia law.
3.3 Itinerary: The Client must provide a detailed itinerary at the time of booking. Genius Limo is not responsible for delays caused by traffic, weather, or inaccurate pickup/drop-off information provided by the Client.
3.4 Subcontracting: In emergencies, Genius Limo may subcontract services to another licensed provider without prior notice, ensuring continuity of service.
4.1 Conduct: The Client is responsible for the behavior of all passengers. Illegal activities, including drug use or underage alcohol consumption, are strictly prohibited under Virginia law. The chauffeur may terminate the service without refund if such activities occur or if passenger conduct jeopardizes safety.
4.2 Damages: The Client is liable for any damage to the vehicle caused by the Client or their party, including but not limited to:
5.1 Chauffeur Authority: The chauffeur reserves the right to refuse service or terminate the trip without refund if they deem the Client or passengers to be a safety risk.
5.2 Force Majeure: Genius Limo is not liable for delays or cancellations due to acts of God, severe weather, mechanical breakdowns, or other events beyond our reasonable control. In such cases, deposits may be credited toward a future booking at the Company’s discretion.
5.3 Limitation of Liability: Genius Limo’s liability for any claim arising from this agreement shall not exceed the total amount paid by the Client for the service. The Company is not responsible for indirect or consequential damages.
6.1 Parental Consent: For prom services, a parent or guardian must sign a “Prom Safety Agreement” outlining rules (e.g., no alcohol for minors) prior to service.
6.2 Curfew: Parents may specify a curfew, which the chauffeur will enforce unless otherwise instructed by the signing parent/guardian.
6.3 Stops: Additional stops during prom service must be pre-approved by the parent/guardian at booking. Last-minute changes are subject to chauffeur discretion for safety and timing.
7.1 Governing Law: This agreement is governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in a court of competent jurisdiction in Virginia.
7.2 Amendments: No alterations to these Terms and Conditions are valid unless agreed to in writing by Genius Limo.
